Terms applicable to credit purchases, payments and digital travel services.

These Terms of Sale govern purchases made on FlyUp4You, including credit purchases, AI-assisted travel reports, AI inspirations and any paid digital service offered on the website.
Important: these Terms of Sale must be completed with the exact legal identity of the seller before public launch.
1. Seller identification
The website FlyUp4You, available at www.flyup4you.com, is operated by: [legal name / company name to complete], [full address to complete], contact email: contact@flyup4you.com.
The seller is referred to as “FlyUp4You”, “we”, “our” or “the seller”. The customer is any person who creates an account, purchases credits or orders a paid digital service on FlyUp4You.
2. Purpose
These Terms of Sale define the conditions applicable to the purchase and use of paid digital services offered by FlyUp4You, including the purchase of credits, AI-assisted travel reports, AI inspirations, account-related services, online consultation, saving and export of reports where available.
These terms apply to every paid order placed through the website.
3. Nature of the service
FlyUp4You provides digital travel preparation tools. The service may help the customer obtain a clearer, structured and practical view of a destination based on the information provided by the customer and the data available at the time of generation.
FlyUp4You does not sell flights, hotels, visas, insurance, transport, restaurant bookings, tourist packages, activities or third-party travel services. FlyUp4You is not a travel agency, tour operator, booking intermediary, carrier, hotel operator or insurer.
AI-assisted reports and inspirations are informational and preparatory tools. They do not replace official checks that the customer must perform before booking, paying a third party or travelling.
4. Acceptance of the Terms of Sale
Before any paid order, the customer must confirm that they have read and accepted these Terms of Sale.
Acceptance is mandatory to complete a paid order. FlyUp4You may refuse or suspend an order in case of abuse, fraud, attempted payment circumvention or use contrary to these terms.
5. Customer account
Certain features require the creation of a customer account. The customer undertakes to provide accurate, complete and up-to-date information.
The customer is responsible for the confidentiality of their login details and for all actions performed from their account. Any unauthorized use must be reported to FlyUp4You as soon as possible.
FlyUp4You may suspend or close an account in case of fraud, attempted fraud, abusive credit use, abusive automation, technical attack, payment circumvention or serious breach of these Terms of Sale.
6. FlyUp4You credits
FlyUp4You may operate with a credit system. Credits allow the customer to order certain digital services on the website, including AI-assisted reports or inspirations.
- Credits can only be used on FlyUp4You.
- Credits are not electronic money.
- Credits cannot be resold, exchanged for cash or transferred to another user without FlyUp4You’s prior agreement.
- Credits are attached to the customer account that purchased them.
Unless otherwise stated at the time of purchase, purchased credits are valid for one year from their purchase date.
Credits not used by the end of this one-year period expire automatically and are not refundable, unless a mandatory legal provision provides otherwise.
7. Prices
The applicable prices are those displayed on the website at the time of the order. Prices may be displayed in euros, US dollars or another currency depending on the customer’s location, selected currency, site configuration or available payment methods.
The total price or the number of credits consumed is displayed before validation of the order. FlyUp4You may change its prices at any time, but price changes do not apply to orders already validated and paid.
If the customer pays in a foreign currency or with a card issued in another currency, conversion fees, bank charges or exchange-rate differences may be applied by the customer’s bank, card issuer or payment provider. These fees do not depend on FlyUp4You.
8. Order process
The order process may include: service selection, account login or creation, completion of the travel form, price or credit calculation, order summary, acceptance of these Terms of Sale, where applicable acceptance of immediate execution of the digital service, payment or credit debit, order confirmation, generation of the report or inspiration, and availability in the customer area where the feature is available.
The customer must check all information entered before confirming the order. Incorrect, incomplete or contradictory information may affect the quality, coherence or relevance of the generated result.
9. Payment
Payments may be processed by an external payment provider, including Stripe. Available payment methods may include, depending on the country, currency and technical configuration, bank card, Bancontact, iDEAL, Apple Pay, Google Pay, Link or any other method displayed at checkout.
FlyUp4You does not directly store the customer’s full bank card details. Payment data is processed by the payment provider according to its own security standards.
The order is considered valid only after effective payment confirmation or valid credit debit. In case of payment failure, cancellation, bank refusal or absence of payment confirmation, the order is not executed.
10. Payment with internal credits
When the customer has enough credits, the service may be paid by debiting the internal balance. The number of credits required is displayed before validation.
The credit debit occurs at order validation or immediately before the launch of the digital generation.
If a technical error completely prevents generation after credits have been debited, FlyUp4You may re-credit the customer account or offer a new generation at no additional cost.
11. Execution of the digital service
Paid digital services are generally executed immediately or shortly after payment confirmation or credit debit.
Generation may depend on the availability of the website, servers, AI providers, third-party services, the quality of the customer’s information and the technical load at the time of the order.
Displayed or estimated generation times are indicative unless expressly stated otherwise.
12. Right of withdrawal — unused credits
When the customer acts as a consumer, they generally have a right of withdrawal strictly limited to fourteen calendar days for distance contracts, unless a legal exception applies.
This period starts on the day the order is concluded or the credits are purchased.
For credits that have not yet been used, the customer may request a refund only within this fourteen-calendar-day period from purchase, provided that the credits have not been consumed to generate a digital service.
After this fourteen-calendar-day period, no withdrawal request will be accepted for purchased credits, unless a mandatory legal provision provides otherwise.
13. Partial use of credits during the withdrawal period
If part of the credits has been used during the withdrawal period, the customer loses the right to a refund for the consumed part. Any refund can only apply to unused credits, provided that the withdrawal request is made within the legal fourteen-calendar-day period and subject to mandatory legal provisions.
The use of one or more credits to generate a report, inspiration or any other digital content constitutes definitive consumption of the credits concerned when the customer has requested immediate execution of the digital service and acknowledged the loss of the right of withdrawal for that execution.
Partial use of credits does not automatically remove the right of withdrawal for unused credits while that right still exists. However, credits already consumed are not refundable.
14. Immediate execution and loss of withdrawal for generated digital content
AI-assisted reports, inspirations and personalized content are digital services or digital content supplied without a physical medium.
When the customer expressly requests immediate execution before the end of the withdrawal period and acknowledges that they lose their right of withdrawal once execution begins, the customer can no longer exercise the right of withdrawal for the report, inspiration or digital content already generated.
Before launching a paid generation, FlyUp4You should collect, where legally required, the customer’s express consent to immediate execution and acknowledgement of the loss of withdrawal rights.
15. Refunds
A refund may be granted in cases such as: payment charged by mistake, duplicate payment for the same order, order paid but digital service not launched and not provided, unused credits where withdrawal is validly exercised within the applicable period, partially used credits only for the unused part within the withdrawal period, major technical error permanently preventing delivery of the paid service, or proven non-conformity when correction or re-generation is impossible or disproportionate.
No refund is due where the report or inspiration has been generated according to the information provided by the customer, where the customer provided incorrect or incomplete information, where the customer changes their mind after generation, where dissatisfaction is purely subjective, where the customer requests a refund for credits already consumed after accepting immediate execution, where the credits have expired, or where the account has been suspended for fraud, abuse or serious breach.
Where technically possible and commercially reasonable, FlyUp4You may prefer correction, re-generation or re-crediting instead of a monetary refund.
16. Free modification period
FlyUp4You may offer, as a commercial gesture, a free modification period of twenty-four hours after the generation of a paid report.
This free modification is limited to reasonable adjustments and does not constitute a complete new order. It may concern pace, some interests, style, food or activity preferences, minor budget adjustments or additional remarks.
It does not apply where the customer changes key trip parameters such as destination, country, main city, dates, duration, number of days, number of travellers, type of service or main report structure.
17. Manual modification by the customer
Where the website allows the customer to manually edit a report after generation, the customer becomes responsible for the changes made.
Once the customer modifies, deletes, adds or validates content manually, FlyUp4You no longer guarantees the coherence, accuracy, balance or quality of the version edited by the customer.
18. Quality and limits of generated information
FlyUp4You strives to provide coherent, useful, structured reports adapted to the information provided by the customer.
AI-assisted reports aim to give the customer a clearer view of the destination and help organize the trip more clearly. However, they must never be considered an official source or a guarantee of absolute accuracy.
The information generated may contain approximations, errors, omissions or outdated information. Before travelling or booking, the customer must verify important information with official sources or the relevant providers.
19. Customer verification obligation
The customer must verify, before booking, paying a third party or travelling, information such as opening hours, prices, availability, booking conditions, exact addresses, transport, visa requirements, health requirements, administrative requirements, local safety, weather, border rules and insurance conditions.
FlyUp4You does not guarantee that places, activities, restaurants, transport or services mentioned in a report will be available, open, accessible, suitable or offered at the indicated price at the time of travel.
20. Travel responsibility
The customer remains solely responsible for the actual organization of their trip, including reservations, travel documents, insurance, compliance with local laws, health and mobility suitability, budget management and official travel warnings.
FlyUp4You is not responsible for denied boarding, denied entry into a country, price changes, closures, third-party cancellations, accidents, delays, security issues, errors by external providers or decisions taken by the customer based on unverified information.
21. Third-party services
Reports may mention or use information from third-party services, such as maps, search tools, geolocation services, payment providers, artificial intelligence providers or public information sources.
FlyUp4You is not responsible for the operation, accuracy, availability or terms of use of third-party services.
22. Website availability
FlyUp4You strives to ensure reasonable website availability. However, the website may be temporarily unavailable due to maintenance, updates, technical failures, overload, hosting issues, network issues, cyberattacks, force majeure or unavailability of a third-party provider.
FlyUp4You does not guarantee permanent, uninterrupted or error-free access.
23. Prohibited use
The customer must not use the website fraudulently, bypass payment, attempt to obtain reports without payment, exploit a technical vulnerability, use abusive bots or scripts, copy site content massively, resell reports as their own without authorization, generate unlawful content or disrupt the normal functioning of the website.
24. Intellectual property
The FlyUp4You website, its structure, texts, interfaces, designs, logos, graphic elements, report templates, databases, code, presentation systems and editorial content are protected by intellectual property law.
The customer receives a personal right to use the report ordered to prepare their own trip or the trip of the persons concerned by the order. Commercial resale, massive extraction or creation of a competing service from FlyUp4You content, structure or methods is prohibited without written authorization.
25. Customer-provided content
The customer is responsible for the information, preferences, names, travel data, stay locations and other elements entered on the website. The customer authorizes FlyUp4You to use this information only as necessary to provide the requested service, manage the order, provide support, improve the service and comply with legal obligations.
26. Personal data
FlyUp4You processes personal data necessary for account operation, payment, report generation, customer support and legal obligations. Detailed rules are set out in the Privacy Policy available on the website.
27. Legal conformity of digital content and services
When the customer acts as a consumer, they benefit from the legal guarantees applicable to digital content and digital services.
In case of proven lack of conformity, the customer must contact FlyUp4You within a reasonable period. FlyUp4You may offer correction, re-generation, re-crediting, price reduction or refund where legally required and where other solutions are impossible, disproportionate or insufficient.
28. Support and complaints
For any question, technical issue or complaint, the customer may contact FlyUp4You at: contact@flyup4you.com.
The customer should provide the account email, order or report reference, order date, precise problem description and screenshots where useful.
29. Proof of order
Data recorded by FlyUp4You, its hosting provider, payment system or technical tools may be used as evidence of the order, payment, report generation, credit use and exchanges with the customer.
30. Promotions
FlyUp4You may offer promotional offers, discounts, bonus credits, promotional codes or temporary benefits. Such offers are valid only during the indicated period and under the conditions displayed at the time of the offer. Unless otherwise stated, promotions are not cumulative.
31. Possible subscriptions
If FlyUp4You later offers subscriptions, specific subscription conditions will be displayed before subscription, including price, duration, renewal, included credits, cancellation conditions, billing date and consequences of cancellation.
32. Limitation of liability
FlyUp4You is liable only for direct damages resulting from a proven breach of its contractual obligations, within the limits permitted by applicable law.
FlyUp4You is not liable for indirect damages, loss of opportunity, loss of enjoyment, customer-caused data loss, commercial losses, travel costs, cancellation fees or consequences of decisions taken by the customer based on unverified information.
Nothing in these terms limits mandatory consumer rights or liability that cannot be excluded by law.
33. Force majeure
FlyUp4You is not liable for delay or non-performance caused by an event reasonably beyond its control, including internet failure, hosting failure, payment provider unavailability, AI provider unavailability, cyberattack, natural disaster, fire, conflict, strike, administrative decision, legal restriction or major political or health event.
34. Changes to the Terms of Sale
FlyUp4You may modify these Terms of Sale at any time. The applicable version is the version accepted by the customer at the time of the order. Future changes do not apply retroactively to orders already validated, unless required by law or accepted by the customer.
35. Severability
If any clause of these Terms of Sale is declared invalid, illegal or unenforceable, the remaining clauses remain applicable. The clause concerned will, where possible, be replaced by a valid clause with a similar legal and economic effect.
36. Applicable law
These Terms of Sale are governed by Belgian law, without prejudice to any more protective mandatory provisions applicable to consumers in their country of residence.
37. Disputes and mediation
In case of dispute, the customer is invited to contact FlyUp4You first in order to seek an amicable solution.
If no amicable solution is found, the consumer may contact the Belgian Consumer Mediation Service where applicable.
38. Languages
These Terms of Sale may be offered in several languages. In case of contradiction between language versions, the French version prevails, unless a mandatory rule applicable to the consumer provides otherwise.
39. Professional customers
When the customer acts for professional purposes, certain protections reserved for consumers may not apply, including the consumer right of withdrawal.
40. Final acceptance
By validating an order, the customer acknowledges that they have received the essential information before payment, understood the digital nature of the service, checked the order summary, accepted these Terms of Sale and understood that FlyUp4You provides digital travel preparation assistance, not a reservation, travel guarantee or travel agency service.
